Recovery Care – Privacy of Personal Health Information
At Recovery Care, protecting your personal health information (PHI) is an essential part of our commitment to safe, respectful, and confidential care. We comply with Ontario’s Personal Health Information Protection Act (PHIPA) and take all reasonable steps to ensure your information is handled responsibly and securely.
Our Commitment to Your Privacy
Recovery Care, together with our physicians, acts as the Health Information Custodian responsible for all personal health information collected, used, and disclosed in the course of providing healthcare. We ensure that every staff member, physician, volunteer, learner, and contractor understands and follows our privacy obligations.
We protect PHI in our custody or control against theft, loss, and unauthorized access, use, disclosure, copying, modification, or disposal.
What We Collect and Why
We collect only the personal health information needed to provide or assist in your care. This may include:
• Contact details and health card information
• Health history, medications, and treatment information
• Records from other healthcare providers
• Information necessary for billing or program administration
We collect this information to:
• Provide and coordinate healthcare
• Reduce or prevent risks of serious harm
• Meet legal, regulatory, and reporting obligations
Consent
We do not collect, use, or disclose your personal health information without consent unless permitted or required by law.
Consent may be implied, verbal, or written. For example, by seeking care at Recovery Care, you give implied consent for us to share information with other healthcare providers involved in your treatment.
You may withhold, withdraw, or modify your consent at any time by completing a Consent Directive Form. Our staff can assist you with this process.
Use and Disclosure of Information
Your information may be used or shared only for purposes permitted by law, including:
• Providing or assisting in your healthcare
• Coordinating care among your providers
• Submitting claims to the Ministry of Health or insurers
• Meeting reporting obligations required by law
We take reasonable steps to ensure any information we use or disclose is accurate, complete, and up to date.
If an unauthorized collection, use, or disclosure occurs, we will notify you at the first reasonable opportunity and inform you of your right to make a complaint to the Information and Privacy Commissioner of Ontario (IPC).
Access to Your Information
You have the right to access and request a copy of your personal health information that is in our custody or control.
Access may be provided in PDF format, through a secure online portal, or another electronic format agreed upon between you and Recovery Care.
In limited cases, access may be refused as allowed by PHIPA (for example, where disclosure could cause serious harm or the information is subject to legal privilege). If only part of a record is exempt, you will receive access to the remainder.
Security and Recordkeeping
We use physical, administrative, and technical safeguards to protect your information:
• Locked storage for paper records
• Password-protected, encrypted electronic systems
• Access restricted to authorized staff who require it for their duties
• Secure destruction of records when no longer required
Records are retained for at least 10 years from the date of your last visit, or 10 years after a minor turns 18, as required by Ontario regulations.
Record Disposal
Records are securely destroyed so that personal health information cannot be reconstructed or identified. Paper records are shredded or pulverized; electronic data is overwritten or physically destroyed. Recovery Care may also use a certified third-party disposal service and keeps disposal records for five years.
Breach Notification
If your personal health information is stolen, lost, or accessed by unauthorized persons, Recovery Care will:
• Notify you as soon as possible, including details of the breach and your right to contact the IPC
• Document the incident in your record
• Report annually to the IPC on any breaches or unauthorized collections
